Rebeca Caquías-Mejías

Rebeca Caquías-Mejías is an attorney with more than 22 years of experience in creditor’s rights including bankruptcy, real estate, commercial lending, secured transactions, asset based finance, workouts and restructuring for a variety of clients, including financial and corporate entities. Her practice principally covers representing unsecured and secured creditors in over two thousand Chapter 11 and 13 bankruptcy cases. In addition, she has represented creditors in the request for modification or lifting of the automatic stay, and adversary proceedings, in the Bankruptcy Court for the District of Puerto Rico and before the Bankruptcy Appellate Panel for the First Circuit.

 

She has also advised financial institutions in the preparation and negotiation of loan documentation, workouts and security arrangements, including financing for shopping centers, service providers and construction sites.  In addition, she is greatly experienced in all manners of lease contracts from shopping center tenants, ground leases, office buildings, and residential leases, advising landlords and tenants.  She also manages sales and acquisitions of real estate properties representing both sellers and purchasers in private sales or within bankruptcy proceedings.

 

Ms. Caquías-Mejías has participated as a speaker in various seminars offered to various clients, including the “Proposed National Chapter 13 Plan, Proof of Claim Issues and FRBP 3002.1” offered by the American Bankruptcy Institute in the Caribbean Insolvency Symposium 2014.

Ms. Caquías-Mejías has successfully defended creditors within the Bankruptcy Court system, among these, the opinion from the Bankruptcy Appellate Panel for the First Circuit, In re Sepulveda Soto, 491 B.R. 307 (1st BAP 2013).

 

Attorney Caquías-Mejías has effectively represented creditors in over 2,000 bankruptcy cases. Ms. Caquías-Mejías has more than 15 years of work experience, focused mainly on serving corporate clients. This experience has allowed Attorney Caquias-Mejias to gain ample knowledge on different areas of Puerto Rico and Federal law, specifically concentrating on bankruptcy law.  Regarding bankruptcy law, Attorney Caquias-Mejias has represented diverse institutions including Rushmore Loan Management Services, LLC, Doral Bank, Doral Recovery II, LLC, Scotiabank de Puerto Rico, Doral Financial Corporation, Doral Financial Creditor’s Trust as successor to Doral Financial Corporation, Banco Popular de Puerto Rico, Simon Property Group, Inc., Seneca Mortgage Servicing and Bautista Cayman Asset Company while she was a Member in one of Puerto Rico's largest and oldest law firms, prior to founding RCM Law Office LLC.
