Rebeca Caquías-Mejías is an attorney with over 24 years of experience in creditor’s rights, including bankruptcy, real estate, commercial lending, secured transactions, asset-based finance, workouts, and restructuring. She has represented a wide range of financial and corporate clients, with her practice focused principally on representing both secured and unsecured creditors in more than two thousand Chapter 11 and Chapter 13 bankruptcy cases.
Her extensive bankruptcy experience includes successfully litigating requests for modification or lifting of the automatic stay, handling adversary proceedings, and representing clients before the U.S. Bankruptcy Court for the District of Puerto Rico as well as the Bankruptcy Appellate Panel for the First Circuit. Notably, she successfully defended creditor interests in In re Sepulveda Soto, 491 B.R. 307 (1st BAP 2013).
Beyond litigation, Ms. Caquías-Mejías regularly advises financial institutions on loan documentation, workouts, and security arrangements, including financing for shopping centers, service providers, and construction projects. She is also highly experienced in lease law, counseling landlords and tenants on a wide range of contracts, from shopping center leases to office buildings, ground leases, and residential agreements. Her real estate practice includes managing sales and acquisitions of properties, representing both sellers and purchasers in private transactions and bankruptcy proceedings.
Ms. Caquías-Mejías has also been an invited speaker at professional seminars, including presenting on “Proposed National Chapter 13 Plan, Proof of Claim Issues, and FRBP 3002.1” at the American Bankruptcy Institute’s Caribbean Insolvency Symposium in 2014.
Throughout her career, she has represented numerous prominent financial institutions and corporate entities, including Rushmore Loan Management Services, LLC, Doral Bank, Doral Recovery II, LLC, Scotiabank de Puerto Rico, Doral Financial Corporation, Doral Financial Creditor’s Trust (as successor to Doral Financial Corporation), Banco Popular de Puerto Rico, Simon Property Group, Inc., Seneca Mortgage Servicing, and Bautista Cayman Asset Company. She gained much of this experience as a Member of one of Puerto Rico’s largest and oldest law firms before founding RCM Law Office LLC.
